PERRELET CARE – Extended Guarantee Service


 

By purchasing PERRELET CARE - Extended Warranty Service through one of the channels where this service is available, You confirm that You have read and agree to these Terms and Conditions which constitute the contract between You and PERRELET in relation to the Service.


 

1.- Name and holder of the Service

The service is provided by PERRELET, S.A., established at Rue Bubenberg 7, 2502 Biel/Bienne (Switzerland), registered in the Registre du Commerce du Canton de Berne, with IDE/UID CHE-107.491.208, Swiss TVA number: CHE-107.491.208 and intra-Community TVA No. ESN0076967I.


 

2.- Description of the Service


 

The Service is offered by PERRELET, S.A. ("PERRELET") at authorized PERRELET distribution points for certain product models of the PERRELET brand depending on the commercial offer available (the "Product(s)").


 

The Service is offered, depending on the case, against payment, either by purchasing it together with the Product or separately or after the purchase of the Product or, if applicable, within the framework of a promotion.


 

The Service covers the correction of defects by repair of the Product within TWENTY-FOUR (24) months after the end of the standard warranty period applicable to the Product under the commercial warranty offered by PERRELET (the "Service Period") without any additional fee or cost for such repair (labor, replacement parts, transportation).


 

The Service constitutes a commercial product repair or replacement warranty which is a TWENTY-FOUR (24) month extension of the commercial warranty period applicable to your purchased PERRELET product and covers possible failures as defined below and subject to the conditions set forth in these Terms and Conditions.

Likewise, the products purchased from PERRELET enjoy the corresponding legal guarantee, established by the legislation in force in the territory of acquisition of the product by the consumer.

The Legal Guarantee and the other legal rights and remedies of the consumer, in accordance with the imperative regulations of consumers and users, shall not be limited in any way by the provisions of these Terms and Conditions. In other words, PERRELET CARE-Extended Warranty Service applies in addition to your other legal and contractual rights and does not limit them.


 

3.- Availability of the Service


 

PERRELET CARE-Extended Warranty Service can be taken out by natural persons (consumers), who are at least 18 years of age, for certain Products ("eligible products") purchased directly from PERRELET or from an authorized PERRELET dealer. 


 

In particular, "eligible products" are PERRELET branded products equipped with the P-331-MH caliber with COSC certification. 


 

Please ask at the point of sale if this Service is available for your PERRELET product.


 

The application for subscription to the PERRELET CARE-Extended Warranty Service must be made within a maximum of 90 days from the date of purchase of the watch.


 

The Service does not apply to accessories that come with the product, such as chargers or earphones, or that have been purchased separately.


 

4.- What does the Service cover?


 

The content of this Extended Warranty Service consists of the direct repair service by PERRELET of the eligible products that show a lack of conformity during the Service Period. PERRELET will provide the repair service free of charge for the products through its official service channels.


 

For clarification purposes, the Extended Warranty Service covers non-conformities that do not allow the device to function correctly and that are considered a manufacturing or operating defect that is the responsibility of the manufacturer as understood in the Consumer and User regulations in force at the time of purchase of the Product, excluding but not limited to:


 

- Those in which the damage is caused by improper use, mechanical damage, knocks, handling, fire, contact with liquids or liquid ingress (corrosion, oxidation), foreign objects, substances, exposure to high and low temperatures, or the total or partial alteration of the Product. Misuse or abuse shall be understood to include any use of the product other than that specified in the documentation and/or instructions provided by PERRELET in relation to the Product.

- Those derived from any unauthorized disassembly, repair, alteration or modification carried out to the Product. Unauthorized shall be understood to include that which is not carried out by PERRELET or by personnel expressly authorized by PERRELET and/or that which is not expressly authorized by PERRELET.

- Those consequences of the use of accessories, spare parts or consumables that are not original PERRELET and/or designed for the Product.

- Those relating to superficial (cosmetic) damage or damage caused by normal use or resulting from ordinary wear and tear of the Product, including but not limited to scratches, indentations, scratches, scratches, abrasions or discoloration of the device, unless the failure has occurred as a result of a defect in materials or workmanship recognized by PERRELET.


 

Exclusions: This Extended Warranty shall not be exercisable in any of the following cases:


 

- Out of Service Period.

- If the serial number of the watch is damaged, has been removed, has been changed, has been tampered with or is difficult to identify.

- If any of the terms contained in this document are altered or modified in any way without the prior consent of PERRELET.

- PERRELET has reasonable grounds to believe that You are not the authorized user of the Product and You do not prove this by producing proof of delivery of the Product in Your name.

- If the malfunction or failure is caused by force majeure (such as earthquakes, fire, lightning, etc.).


 

If the Product is not eligible for repair under the Extended Warranty Service, PERRELET shall contact the customer to inform him/her that the repair is not free of charge and may offer the customer the issuance of a repair estimated by PERRELET or the technical support service.


 

5.- Enforcing the Service and Requesting Repairs


 

To request a repair under this Service the consumer must do so by going to an Authorized Dealer or by contacting PERRELET within the Service Period. The repair service is performed by PERRELET's authorized technical support services (the "CUSTOMER SERVICE"). What documents need to be provided? It is necessary to provide documentary evidence of the purchase of the Product and a copy of the warranty card duly filled by an authorized retailer and its date (receipt or invoice). 


 

The provision of repair services shall be subject to specific conditions that will be communicated to you by the "CUSTOMER SERVICE" in a timely manner prior to the provision of the service.


 

6.- Exchanges and Returns


 

Return of the Service: If you wish to return PERRELET CARE-Extended Warranty Service, you may do so without giving any reason within 14 days from the day of purchase of the Service. After this period has elapsed, it will not be possible to return the PERRELET CARE-Extended Warranty Service and no refund will be made. The refund will be made in the same way as the original payment.


 

Exchanges or returns of the Product: Please note that the purchase of the Product is subject to the conditions of sale and returns which can be consulted at the point of sale from your retailer at the time of purchase. In case the PERRELET Product was purchased on the official PERRELET website or app and is exchanged for another of the same type within 14 days from the day after delivery, the Extended Warranty Service will be automatically added for the new PERRELET Product.


 

7.- Applicable Law


 

These Terms and Conditions are governed by the laws of Switzerland applicable at the time the Service is purchased. Nothing in these Terms and Conditions limits the statutory rights of consumers under mandatory consumer protection laws. The Service is not an insurance policy. The Service constitutes a special commercial guarantee offered by PERRELET in its capacity as producer or manufacturer in respect of certain PERRELET branded products.


 

8.- Privacy Notice


 

In compliance with the provisions of the General Data Protection Regulation -GPRD- (EU Regulation 2016/679) and the national regulations adapting it, as well as the Swiss Federal Data Protection Act -DSG- and the Ordinance on the Federal Data Protection Act -VDSG-, PERRELET informs its customers that the personal data provided will be included in an automated personal data file, created and maintained under the responsibility of PERRELET, S.A. as the party responsible for the file.


 

Likewise, in case of requesting a repair in execution of the Service, the data collected such as the details of the device or the information provided to the customer service and the PERRELET Authorized Technical Assistance Centre, will be treated by PERRELET, responsible for the treatment, in accordance with its privacy policy.


 

If the requested repair is not covered by the Extended Warranty Service, in this case the TAS may offer to repair your device directly and issue a quotation at your request. In this case, the data will also be processed by the TAS where you request the repair, as an independent data controller, in accordance with the privacy policy that you can consult at the time of requesting the repair.

10.- Entire Agreement, Termination, Revisions and Modifications


 

These Terms and Conditions (as amended or modified from time to time) and the documents expressly referred to in them constitute the entire terms of the Agreement.


 

If a court or competent authority decides that any provision of these Conditions or any provision of the Agreement is void, illegal or unenforceable to any extent, that condition will be void, but only to that extent as the remaining Conditions will continue to be valid to the fullest extentpermitted by law.
